risk management

With the price of referral fees being at an all time high and most commonly, non-refundable in the event that your claim does not proceed, we would like to be able to offer a front end service designed to assist you with your risk management.

Experience tells us that inadequate risk assessment both at the outset and during the early stages of any civil claim, may lead to an unnecessary exposure to significant write –offs, which will have a damaging affect to your practice in more ways than one.

Client care is never put to the test more, than when client’s expectations are not managed quickly and efficiently. This starts with the very first contact that is made, and we believe we can have a big part to play in this, that will be to your benefit.

Whatever your work sources may be, a claim with no reasonable prospects, needs weeding out of the system as quickly as possible, although we appreciate the need to fully investigate each and every claim on its own merits.

With our vast experience in managing risk, we can offer a couple of options, which may fit into your case plan. At present these options will be dealt with hand in hand with any initial CFA or retainer sign up, although we can provide both options at any time within the preliminary stages of the claim, and in any event, we would recommend, within the protocol period.

Option 1 - Preliminary information review and short-form report.

We will interview your client and after completion of your retainer will complete a fact finding exercise specific to the category of case involved. Upon completion of this we will prepare a short-form report highlighting what we believe are the cases strengths and weaknesses, and make our recommendations.

Option 2 - Provisional liability/causation statement and short form report.

This option will involve the same process as above but will include the preparation of a draft liability and/or causation statement. We would point out that any such statement would be solely to assist you with your initial risk assessment, and not intended for disclosure following the issue of court proceedings.

We are also able to offer similar risk assessments at the latter stages of the claims process. The timing and format of such further assessments, can be discussed if you would be interested in this service.
